These Terms and Conditions (“Terms”) govern your use of our website, online learning platform, mobile application, and any related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services. 1. Eligibility • You must be at least 18 years old to use the Services. • If you are under 18 and wish to receive this kind of education, visit our non-profit partner program for youth under age 18 at www.4eee.com • By using the Services, you confirm that you meet these requirements. 2. Accounts • To access certain features, you must create an account with accurate and complete information. • You are responsible for maintaining the confidentiality of your login credentials. • You are responsible for all activity under your account. • Tracker School reserves the right to suspend or terminate accounts that provide false information or violate these Terms. 3. Course Access and License • Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the course materials for personal, non-commercial use only. • You may not copy, reproduce, distribute, sell, or share course content with others. • Access to online courses is provided as long as Tracker School makes the content available. Tracker School may update, modify, or remove content at its discretion. 4. Payments, Pricing, and Refunds • Prices for courses and subscriptions are listed in U.S. Dollars unless otherwise specified. • Payments must be made using the payment methods provided on the platform. • All sales are final. Refunds are only granted if required by law or if otherwise specified in a published refund policy. • For subscription-based services, you authorize Tracker School to charge your chosen payment method on a recurring basis until you cancel. 5. Mobile App License • Tracker School grants you a limited, non-exclusive, non-transferable license to download and use the mobile app for personal educational purposes. • You must also comply with the applicable terms of the Apple App Store or Google Play Store. • Tracker School may update or discontinue the app at any time without notice. 6. Intellectual Property Rights • All content, trademarks, logos, and materials provided through the Services are owned by or licensed to Tracker School. • You are not granted any ownership rights. • You may not use Tracker School’s intellectual property without prior written consent. 7. User Conduct You agree not to: • Use the Services for unlawful purposes. • Share, copy, or redistribute course materials. • Harass, abuse, or harm instructors, staff, or other users. • Attempt to hack, disrupt, or interfere with the platform or app. 8. Disclaimers • The Services are provided for educational purposes only. • Tracker School does not guarantee uninterrupted access, error-free operation, or specific results from participation in courses. • To the fullest extent permitted by law, Tracker School disclaims all warranties, express or implied. 9. Limitation of Liability • Tracker School shall not be liable for indirect, incidental, special, or consequential damages. • Tracker School’s total liability to you for any claim shall not exceed the amount you paid for the Services giving rise to the claim. 10. Termination • Tracker School may suspend or terminate your access to the Services at any time for violations of these Terms. • Upon termination, all licenses granted to you will immediately end. 12. Governing Law and Dispute Resolution • These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. • Any disputes shall be resolved exclusively in the state or federal courts located in Monmouth County, New Jersey, unless arbitration is agreed upon by both parties. 13. Changes to Terms Tracker School reserves the right to update these Terms at any time. Updates will be posted on the website and/or app. Your continued use of the Services after changes are posted constitutes acceptance of the new Terms. 14. In-Person Wilderness Training 14.1 Health and Fitness • Participation in wilderness training may involve strenuous physical activity, outdoor environments, exposure to wildlife, weather, and natural hazards. • By enrolling, you confirm that you are physically fit to participate and that you have disclosed any relevant medical conditions. • Tracker School reserves the right to deny participation if it reasonably believes a participant’s health or safety may be at risk. 14.2 Assumption of Risk • By attending in-person training, you voluntarily assume all risks of injury, illness, accident, or property damage associated with wilderness activities. • Tracker School, its instructors, staff, and affiliates shall not be held liable for any such events, except where prohibited by law. 14.3 Emergency Medical Care • You authorize Tracker School staff to provide or arrange emergency medical treatment if necessary. • You are responsible for any resulting medical expenses. 14.4 Code of Conduct • Participants must follow all instructor guidelines and safety protocols. • The use of alcohol, illegal drugs, or disruptive behavior is strictly prohibited. • Tracker School reserves the right to remove participants who violate conduct rules without refund. 14.5 Media Release • Tracker School may photograph, film, or otherwise record in-person events. By attending, you grant Tracker School the right to use your image, voice, or likeness for educational or promotional purposes, unless you opt out in writing before the program begins. 14.6 Participation Agreement • You agree to our Participation Agreement at https://trackerschool.ezycourse.com/class-agreement If there are any conflicting terms, the Participation Agreement takes precedence over these Terms and Conditions. 15.
